HR interview after being given an offer

I'm asking for someone I know, let's call him James.



James has applied for an offer a while ago for a big company, they answer him and they've said that they were very interested in his profile and they were looking for someone similar for quite a while ago.



After 3 interview, 2 with HR and a technical interview, James was contacted by company to offer him a job, but the thing is the time when they want him to be ready is not possible because the terms in the current contact are stating that he leaves a notice before X number of months before leaving so that they can start searching for another one. Even though James has explained this to them and that he can't be available at the mentionned time, they didn't respond to him.



Lately James received an email from the company that they're still looking for someone for that same position and that his profile was already interesting enough during the past interviews, but he has to be interviewed again by HR, and it's not clear or not if there are other interviews.



So what do you guys think, do you really think that the company is serious about their search for a candidate ? What would you do in this case ? (for James the offer is good, but the problem is the thing that I've explained above)

Only the company knows this for certain, but the fact that they did not respond to his question about notice period could mean they decided not to hire him for the first opportunity.




What would you do in this case?




One thing to do for certain is to find out if the X-month notice period is acceptable, preferably before conducting an interview. If they are not willing to answer that question (even if it's a "we'll see" answer) then I would question their sincerity. For all James knows, they are hoping James will leave before the notice period, essentially breaking the contract.
